A.P.E. remains the sole owner of the construction drawings for the supplied goods.
The purchaser undertakes not to deliver any drawings or information it receives to third parties, and not to reproduce or use such for other purposes.
The purchaser undertakes to ascertain that the use to which the design and/or technology of the goods supplied by A.P.E. is put does not infringe any third-party industrial rights, and assumes exclusive responsibility for any consequences deriving from such infringements, and undertakes to indemnify A.P.E. against such.
Should the goods be manufactured by A.P.E. according to specific technical documents provided by the purchaser, and should such documents infringe any third-party industrial property rights, the purchaser undertakes to guarantee and indemnify A.P.E. against any third-party claims.
